1. Acceptance of Terms

By accessing or using the QubeAuditor platform (the "Service"), operated by Konzern AI DOO ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

QubeAuditor is a Kubernetes security auditing and compliance platform that scans clusters using industry-standard tools, maps findings to compliance frameworks, and generates reports. The Service is provided on a subscription basis as described on our website and in any applicable order form or agreement.

3. User Accounts

To use certain features of the Service, you must register for an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws
  • Interfere with or disrupt the integrity or performance of the Service
  • Attempt to gain unauthorized access to the Service or its related systems
  • Reverse engineer, decompile, or disassemble any portion of the Service
  • Use the Service to scan systems you do not own or have explicit permission to audit
  • Upload or transmit any viruses, malware, or other malicious code

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Konzern AI DOO and its licensors. The Service is protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

You retain all rights to your data. By using the Service, you grant us a limited license to process your data solely for the purpose of providing and improving the Service.

6. Confidentiality

We understand that you may provide us with access to sensitive security information. We agree to maintain the confidentiality of your data and scan results and will not disclose such information to third parties except as required by law or as necessary to provide the Service.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WHILE WE STRIVE TO PROVIDE ACCURATE SECURITY AUDITS AND FINDINGS, WE DO NOT GUARANTEE THAT THE SERVICE WILL IDENTIFY ALL VULNERABILITIES OR MISCONFIGURATIONS. YOU ARE RESPONSIBLE FOR VERIFYING AND ACTING ON SCAN RESULTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KONZERN AI DOO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for any claims arising from or relating to these Terms or the Service shall not exceed the amount you paid us for the Service during the twelve (12) months preceding the claim.

9. Subscription and Payment

The Service is billed on a subscription basis according to the plan you select. You agree to pay all fees associated with your subscription. Fees are non-refundable except as required by law or as explicitly stated in a written agreement.

We reserve the right to change our pricing at any time. Any pricing changes will take effect at the beginning of your next billing cycle, and we will provide advance notice of such changes.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may cancel your subscription at any time. Your data will be retained for a reasonable period to allow you to export it, after which it will be deleted in accordance with our Privacy Policy.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Belgrade, Serbia.

12. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of significant changes by posting the updated Terms on this page with a revised "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
